Terms of Service

These Terms of Service are a binding agreement between you and HomeHeroLocal LLC, a Virginia limited liability company (HomeHeroLocal, we, us, or our). They apply to the HomeHeroLocal website, mobile application, communications, and related marketplace services offered in supported areas of Virginia, Maryland, and Washington, DC. You must be at least 18 years old and legally capable of entering a contract to create an account or use account-only features. If you use HomeHeroLocal for a business, you represent that you are authorized to bind that business. By creating an account or continuing after a required update, you agree to the version presented to you.

HomeHeroLocal provides technology that helps Customers discover and communicate with independent home-service businesses called Heroes. HomeHeroLocal does not itself provide home services, employ Heroes, supervise or direct their work, or become a party to a Customer-Hero service agreement. Heroes are independent businesses and are not employees, agents, partners, franchisees, or representatives of HomeHeroLocal and cannot bind HomeHeroLocal.

HomeHeroLocal does not conduct background checks and does not independently verify a Hero’s identity, licenses, permits, registrations, insurance, experience, statements, availability, or suitability. Signup certifications and profile information are supplied by Heroes and do not constitute endorsement, certification, or a guarantee by HomeHeroLocal. If these practices change, HomeHeroLocal will disclose the change prospectively in a new legal version.

You must provide accurate information, protect your credentials, promptly update material changes, and notify us at legal@homeherolocal.com if you suspect unauthorized use. You are responsible for activity under your account except to the extent caused by HomeHeroLocal or prohibited by law.

You may not use HomeHeroLocal unlawfully; impersonate another person or business; misrepresent credentials or services; harass, threaten, discriminate against, exploit, or defraud another person; interfere with security or operation; scrape or harvest data; upload malware; manipulate reviews, requests, appearances, or metrics; or use private information for an unrelated purpose.

Customers and Heroes decide whether to work together and agree directly on scope, price, schedule, materials, access, cancellations, warranties, payment, refunds, and dispute terms. Customers currently pay Heroes directly outside HomeHeroLocal. HomeHeroLocal does not collect, hold, transfer, guarantee, or refund Customer-to-Hero service payments and is not responsible for taxes, liens, permits, financing, chargebacks, or collection arising from a direct service agreement.

Each user is responsible for evaluating the other party and preserving their direct contract, estimate, invoice, receipt, warranty, and project records. Marketplace messages, price guidance, profiles, ratings, and reviews are informational and do not replace appropriate due diligence or professional advice.

HomeHeroLocal is not an emergency service. Call 911 or the appropriate authority for emergencies, immediate danger, suspected crime, fire, gas, electrical, structural, health, or other urgent risks. Users are responsible for safe communications, site access, working conditions, property protection, and compliance with applicable law.

A dispute concerning a Hero’s services, workmanship, scheduling, property damage, direct payment, cancellation, refund, or warranty is principally between the Customer and Hero. To the fullest extent permitted by law, each user agrees to pursue the other contracting user for claims arising from their direct service agreement. This does not release HomeHeroLocal from responsibility for its own conduct where liability cannot lawfully be excluded.

Use Report to bring objectionable messages, reviews, profiles, or uploaded content to HomeHeroLocal’s attention, and Block to limit communication with an abusive user. Authorized staff may review reports, remove violating content, and restrict accounts. You must not submit hateful, threatening, sexually exploitative, or otherwise unlawful content. New public media may remain unpublished until staff review. Reporting or blocking does not cancel your direct service agreement or replace emergency assistance. You retain ownership of content you submit. For content you deliberately submit for public display, such as a Hero profile, portfolio photo, or review, you grant HomeHeroLocal a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, display, and distribute it as reasonably needed to operate and promote the marketplace, subject to the Privacy Policy and your available settings. For private messages and private media, the license is limited to storing, processing, transmitting, securing, moderating when authorized, and supporting that private marketplace interaction. You represent that you have the rights needed to submit all content.

Reviews must reflect genuine marketplace interactions and honest opinions. We may refuse, restrict, or remove content that violates these Terms, infringes rights, creates safety or legal risk, or undermines marketplace integrity. HomeHeroLocal names, branding, software, design, and original content remain owned by HomeHeroLocal or its licensors and may not be copied or exploited without permission.

The service may rely on third-party hosting, database, storage, mapping, geocoding, email, network, device, and app-store services. Their availability and separate terms may affect features. Links or integrations do not constitute endorsement, and HomeHeroLocal is not responsible for third-party services outside its control.

HomeHeroLocal does not guarantee continuous availability, any number or quality of leads, requests, jobs, customers, rankings, reviews, earnings, payments, or business results. We may maintain, change, restrict, suspend, or discontinue any feature or the service for operational, safety, security, legal, financial, or business reasons, with notice when reasonably practical and as required by law.

We may restrict or terminate an account for violation, suspected fraud, safety risk, unsupported material claims, legal requirements, prolonged inactivity, or service discontinuation. Users should retain their direct business records. Termination does not cancel accrued direct obligations, lawful data-retention duties, or provisions that by their nature should survive, including ownership, disclaimers, risk allocation, and dispute provisions.

To the fullest extent permitted by law, the marketplace is provided as is and as available. HomeHeroLocal disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and warranties arising from course of dealing. HomeHeroLocal does not warrant user identity, statements, credentials, conduct, service quality, safety, legality, availability, or results.

To the fullest extent permitted by law, HomeHeroLocal and its members, managers, officers, employees, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, revenue, data, goodwill, or opportunities, arising from use of the marketplace or a direct Customer-Hero agreement. These exclusions do not apply where prohibited or to rights or liabilities that cannot lawfully be waived or limited.

The Privacy Policy explains how HomeHeroLocal handles personal information. The Electronic Records and Communications Consent governs electronic legal records. Transactional communications needed to operate or secure an account are not marketing messages and may continue while an account is active or as otherwise permitted by law.

Virginia law governs these Terms without regard to conflict-of-law rules, except where applicable consumer law requires otherwise. Any court proceeding against HomeHeroLocal must be brought in a state or federal court with jurisdiction in or serving Loudoun County, Virginia, unless applicable law gives you a non-waivable right to proceed elsewhere. These Terms do not require arbitration and do not waive participation in a class action.

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions remain effective. A failure to enforce is not a waiver. You may not assign your account or agreement without our consent; HomeHeroLocal may assign these Terms in connection with a merger, financing, reorganization, asset transfer, or sale, subject to applicable law. These Terms, the role-specific agreement or acknowledgment, the Privacy Policy, and Electronic Records Consent form the agreement governing the marketplace.

We may update these Terms prospectively. When a change is material, we will provide notice and request renewed acceptance before continued account-only marketplace use when required by our release process or applicable law.
